What is Colorado's Proposition 122, and how does it impact psychedelics?

Colorado's Proposition 122 represents a significant shift in the state's approach to certain psychedelics, aiming to decriminalize and regulate their use for individuals aged 21 and over.

Key Points of Proposition 122:

  • Decriminalization: Proposition 122 decriminalizes the personal possession, cultivation, sharing, and consumption (excluding sale) of specific natural psychedelic substances, including psilocybin and psilocin from psychedelic mushrooms, dimethyltryptamine (DMT), ibogaine, and mescaline.
  • Supervised Consumption: By the end of 2024, provisions will be established to allow supervised consumption of psychedelic mushrooms at regulated establishments for individuals over 21. Furthermore, the state plans to develop a comprehensive regulatory framework for these establishments.

  • Local Government Regulation: While local governments are prohibited from banning licensed venues or the services they provide, they retain authority to regulate operational hours, locations, and modalities of these establishments.
  • Penalties: Penalties will be enforced for individuals under 21 found in possession, consumption, or transportation of these psychedelic substances. Additionally, adults aged 21 and over will face consequences for providing underage individuals access to these substances.
